Changes to the pandemic sick pay as of 1 December 2021

On 12 November 2021, the Slovak Parliament approved Act No. 412/2021 Coll., amending and supplementing certain acts.

One of these acts is Act No. 461/2003 Coll. on social insurance and Act No. 462/2003 Coll. on income compensation in the event of temporary work incapacity of an employee.

Act No. 461/2003 Coll. on social insurance has a new Section 293fel, which reads:

"In case the temporary work incapacity arose after 30 November 2021, the provisions of Section 293er(1) and (2) and Section 293fek(3) do not apply."

In practice, this means that for quarantines starting after 30 November 2021 – that is, starting from 1 December 2021 or later – the insured person will no longer be entitled to pandemic sick pay.

The employee will continue to be entitled to standard sick pay, reimbursed by the employer from the 1st to the 10th day under Act No 462/2003 Coll.:

  • 25% of the daily reference amount for the 1st to 3rd day of sick leave;
  • 55% of the daily reference amount for the 4th to 10th day of sick leave;
  • from the 11th day onwards, the employee receives sick pay from the Social Insurance Authority equal to 55% of the daily reference amount.

Pandemic sick leaves that started in November and were not completed by 30 November will still fall under the previous arrangement.

Act No. 462/2003 Coll. on income compensation for temporary work incapacity of an employee has a new Section 13ba under which the right to income compensation for temporary work incapacity due to a quarantine measure is claimed from the employer by notifying of the start of the temporary work incapacity.
